Terms & Conditions

These Terms and Conditions ("Agreement") govern all services provided by CANCAS.STUDIO ("we", "us", "the Studio") to clients ("you", "the Client"). By engaging our services or making any payment, you agree to be bound by this Agreement in full.

1. Services

CANCAS.STUDIO provides custom website design, development, AI integration, and hosting management services. The exact scope of work is confirmed in writing (via email or project brief) prior to commencement. Any features, pages, or integrations not included in the agreed scope will be quoted separately.

2. Payment Plans

A non-refundable deposit of 50% of the agreed project cost (or the equivalent of the first month's fee for managed plans) is required to begin work. The remaining balance is due upon project completion, before the website goes live. All payments are final once work has commenced.

3. Website File Transfer on Cancellation

Upon cancellation of a Managed Monthly Plan, the Client may request a full transfer of their website source code and associated assets at any time. This transfer is provided at no additional charge. If the Client wishes to also transfer ownership of the domain registered under their managed plan, additional costs may apply depending on domain registrar transfer fees. These costs will be confirmed with the CANCAS.STUDIO team and quoted to the Client before any transfer is initiated. No domain transfer will proceed without the Client's explicit written approval.

4. Domain Names

On all Managed Monthly Plans, one complimentary domain is included. CANCAS.STUDIO will register the best available domain that closely matches your business name. If your preferred domain is unavailable, we will present the closest available alternatives and confirm the selection with you before registering.

If you require a specific or premium domain that must be purchased from a third-party marketplace or registrar, the acquisition cost will be confirmed with our team and quoted to you before any purchase is made. No premium domain spend will be incurred without your prior written approval.

On One-Time Purchase plans, domain registration and ongoing annual renewal are the Client's sole responsibility. We are happy to advise on selection and assist with technical setup at no additional charge.

5. Minor Edits & Maintenance

Managed Monthly Plan clients are entitled to a set allowance of minor edits per month as specified in their package (e.g. text updates, image swaps, contact detail changes, small layout adjustments). A "minor edit" is defined as a change that takes under 30 minutes to implement. Requests that require new design work, additional pages, or significant development will be scoped and quoted separately. Unused monthly edit allowances do not carry over to subsequent months.

One-Time Purchase clients receive post-launch support for the period specified in their package. After this period, support and edits are available on request at our standard rate, confirmed per task.

6. Revisions During Build

Each package includes a defined number of revision rounds during the build phase. A "revision" means changes to existing design or content within the agreed scope — not new features, new pages, or material changes to scope. Out-of-scope requests will be quoted before implementation.

7. Timelines & Delivery

Estimated delivery timelines are provided at the start of each project and are contingent on the Client providing all required content (text, images, logos, credentials) in a timely manner. Delays caused by the Client's failure to provide content will not be considered a breach by CANCAS.STUDIO. We are not liable for delays caused by third-party services, platforms, or hosting providers.

8. Client Responsibilities

• Provide accurate business information, brand assets, and content promptly.
• Review and approve design mockups within 7 business days of submission.
• Ensure all content supplied is legally owned or licensed by you.
• Keep login credentials and admin access secure.
• Notify us promptly of any issues or required changes.

9. Intellectual Property

Upon receipt of full and final payment, ownership of all custom design and code created specifically for your project transfers to you. We retain the right to display your completed project in our portfolio unless you request otherwise in writing. Third-party plugins, themes, or libraries used in your project remain subject to their respective licences.

10. Cancellation & Refunds

The initial deposit is non-refundable. If a project is cancelled by the Client after work has commenced, payment is due for all work completed up to the cancellation date, calculated at our standard rate. No refunds are issued for completed and delivered work. For monthly managed plans, no partial-month refunds are issued — service continues until the end of the final paid billing period following cancellation notice.

12. Confidentiality

Both parties agree to keep confidential any proprietary information, trade secrets, or business data shared during the project. This obligation survives termination of the Agreement.

13. Limitation of Liability

CANCAS.STUDIO's total liability under this Agreement shall not exceed the total fees paid by the Client in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages including loss of revenue, data, or business opportunity.

14. Governing Law

This Agreement is governed by the laws of the United Arab Emirates. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of Dubai, UAE.

15. Amendments

CANCAS.STUDIO reserves the right to update these Terms at any time. Updated terms will be posted on our website. Continued use of our services following an update constitutes acceptance of the revised terms.
